Welcome to BookEasy.ph. These Terms of Service ("Terms") govern your access to and use of our online booking platform and services. By creating an account, using our services, or accessing our platform, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use BookEasy.ph. We reserve the right to modify these Terms at any time, and your continued use of our services after such modifications constitutes acceptance of the updated Terms.

1. Service Description

BookEasy.ph is an online booking platform designed for service-based businesses in the Philippines, including but not limited to salons, spas, clinics, dental offices, veterinary clinics, and other appointment-based service providers.

Our services include:

  • Online appointment booking and scheduling system
  • Client database and customer relationship management (CRM) tools
  • Calendar management and appointment notifications
  • Business profile and service listing management
  • Booking confirmation and reminder notifications

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice.

2. Account Registration and Eligibility

To use BookEasy.ph, you must:

  • Be at least 18 years of age
  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Be responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You may not create multiple accounts, share your account with others, or use another person's account without authorization.

3. User Responsibilities

For Business Owners:

  • You are responsible for the accuracy of your business information, services, pricing, and availability
  • You must honor all confirmed bookings made through the platform
  • You are responsible for managing your staff schedules and availability
  • You must comply with all applicable laws and regulations in operating your business
  • You must not use the platform for illegal activities or to facilitate fraudulent transactions
  • You are responsible for maintaining the confidentiality of client information shared through the platform

For Clients/Customers:

  • You must provide accurate contact information when making bookings
  • You are responsible for arriving on time for your appointments
  • You must cancel or reschedule appointments in a timely manner if needed
  • You must not make false or fraudulent bookings
  • You must respect the business owner's policies regarding cancellations and no-shows

Prohibited Activities:

  • Using the platform for any illegal purpose or in violation of any applicable laws
  • Attempting to gain unauthorized access to the platform or other users' accounts
  • Transmitting viruses, malware, or any harmful code
  • Harassing, abusing, or harming other users
  • Impersonating another person or entity
  • Collecting or harvesting information about other users without consent
  • Interfering with or disrupting the platform's functionality

4. Payments and Subscription

BookEasy.ph offers subscription plans with different features and pricing tiers. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page.

Subscription Terms:

  • Subscription fees are billed monthly in advance
  • All fees are in Philippine Pesos (₱) unless otherwise stated
  • Fees are non-refundable except as required by law or as explicitly stated in these Terms
  • We reserve the right to change our pricing with 30 days' notice to existing subscribers
  • If payment fails, we may suspend or terminate your account

Cancellation and Refunds:

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of your current billing period
  • No refunds will be provided for partial billing periods
  • Upon cancellation, you will retain access to paid features until the end of your billing period

We use third-party payment processors to handle transactions. By making a payment, you agree to the terms and conditions of the payment processor.

5. Bookings and Appointments

BookEasy.ph facilitates the booking process between business owners and clients. We are not a party to the actual service agreement between the business and the client.

  • Business owners are solely responsible for providing the services booked through the platform
  • BookEasy.ph is not responsible for the quality, safety, or delivery of services provided by business owners
  • Any disputes regarding services must be resolved directly between the business owner and the client
  • Business owners may set their own cancellation and no-show policies
  • Clients are expected to honor their bookings and comply with the business owner's policies

6. Intellectual Property

The BookEasy.ph platform, including its design, features, functionality, and content, is owned by BookEasy.ph and protected by Philippine and international copyright, trademark, and other intellectual property laws.

  • You may not copy, modify, distribute, or create derivative works based on our platform without written permission
  • You retain ownership of any content you upload or create on the platform (e.g., business profiles, service descriptions)
  • By using the platform, you grant us a license to use, display, and distribute your content as necessary to provide our services
  • You may not use our trademarks, logos, or brand names without our prior written consent

7. Limitation of Liability and Disclaimers

Service Availability: We strive to provide reliable service, but we do not guarantee that the platform will be available 100% of the time. The platform may be unavailable due to maintenance, technical issues, or circumstances beyond our control.

No Warranty: BookEasy.ph is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be error-free, secure, or uninterrupted.

Limitation of Liability: To the maximum extent permitted by Philippine law, BookEasy.ph and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the platform.

Maximum Liability: Our total liability for any claims arising from your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

Third-Party Services: We are not responsible for the actions, content, or services of third-party providers, including payment processors, hosting services, or other integrated services.

8. Indemnification

You agree to indemnify, defend, and hold harmless BookEasy.ph, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your provision of services to clients through the platform
  • Any content you upload or transmit through the platform

9. Termination

Termination by You: You may terminate your account at any time by canceling your subscription and closing your account through your account settings.

Termination by Us: We may suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms or any applicable laws
  • You engage in fraudulent, abusive, or illegal activity
  • You fail to pay subscription fees when due
  • We determine that your use of the platform poses a risk to us or other users
  • We discontinue the service (with reasonable notice when possible)

Effect of Termination: Upon termination, your right to use the platform will immediately cease. We may delete your account and data, subject to our data retention policies and legal requirements. You will not be entitled to any refund for fees paid prior to termination.

10. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Jurisdiction: Any disputes arising from or relating to these Terms or your use of BookEasy.ph shall be subject to the exclusive jurisdiction of the courts of the Philippines.

Dispute Resolution: Before filing any legal action, we encourage you to contact us to resolve disputes amicably. If a dispute cannot be resolved through good faith negotiations, it shall be resolved through the appropriate courts in the Philippines.

11. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BookEasy.ph regarding your use of the platform.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or government actions.
